Former pro-Beijing lawmaker Wong Kwok-hing says he and four other people will file an application for a judicial review on Tuesday as to whether Au Lok-hin was a valid candidate in Sunday's by-election. Au won the Hong Kong Island constituency.

Wong, from the Federation of Trade Unions, said election authorities ignored their repeated complaints.

The pro-establishment group says Au had advocated self-determination for Hong Kong and burnt a copy of the Basic Law in the past, meaning that he would not genuinely uphold the mini-constitution.

A government spokesman says it would not comment on the case as legal proceedings will soon begin.

He said: "In fact, resolution of disputes arising from elections through judicial proceedings, including election petitions, is a common occurrence and an integral part of the electoral system in Hong Kong."
