A local deputy to the National People's Congress, Cheng Yiu-tong, was acquitted of careless driving on Wednesday, after an Eastern Court magistrate criticised the police for their handling of the case.

A minivan driver had accused Cheng of crashing into the back of his vehicle as the NPC delegate drove through Aberdeen in July last year.

But Cheng denied this and said in fact, it was the minivan driver that had smashed into the back of his car at high speed.

The magistrate said the burden of proof lay on the prosecution and it had failed to provide sufficient evidence against Cheng.

It also seemed like the minivan driver and his employer could have given false testimony, the magistrate said, noting their descriptions of how damaged the van was didn't match.

The magistrate asked the Department of Justice to follow up on the authenticity of the statements given in court.

He also complained that the police investigation into the alleged smash had been sloppy.
