Businessman Lew Mon-hung has been given the green light to take a legal challenge over a conviction for perverting the course of justice to the Court of Final Appeal.

The supporter-turned-critic of former Chief Executive CY Leung was sentenced to 18 months in jail in 2016 for sending letters and emails to Leung and the ICAC commissioner in an attempt to halt an investigation into bribery and money laundering allegations levelled at him.

Lew lost a bid to overturn his conviction in the Court of Appeal two months ago, and he subsequently applied for leave to take his case to the city's top court, raising questions about the nature of the administrative relationship between the anti-corruption watchdog and the government head.

In handing down their judgement, a panel of three judges approved Lew's application, saying that he had raised important questions about the duties of the Chief Executive and the ICAC commissioner, as well as their powers to end graft investigations.
