The Law Reform Commission on Wednesday launched a four-month public consultation aimed at improving the way the amount of compensation is calculated in personal injury litigation.

They include cases involving traffic accidents, medical blunders and workplace accidents.

Right now, a trial judge can only order a defendant to pay a lump sum. But the commission has suggested introducing a payment system under which compensation is made monthly or quarterly.

The sum could be adjusted, taking into consideration factors such as inflation and changes in medical expenses.

"In order to give effect to that principle of full compensation, it would appear that periodical payment is a logical solution," said Senior Counsel Raymond Leung who is the chairman of a sub-committee looking into the matter.
